Terms and Conditions

Welcome to POPTICKET Limited

POPTICKET Limited is here to help organise events and sell e-Tickets online. We help event organisers to plan, promote, share and sell e-Tickets in an easier way. The followings contain our terms and conditions, which govern all use of our services and users will have complied to have agreed and accepted.

Definitions

We: We shall mean POPTICKET Limited.
Buyer: Buyer shall mean the individual purchasing e-Tickets to an Organiser-hosted event through POPTICKET Limited.
Organiser: Organiser shall mean the individual or organization that is hosting and registering the event with POPTICKET Limited.
Services: Services shall refer to any services available on or through the Site provided by POPTICKET Limited and all software made available to Organiser.
Site: Site shall mean POPTICKET Limited website and all subparts therein.
You: You shall mean Buyer, Organiser and every individual using this Site.

Registration

To be a registered user of the Services, whether as an Organiser, Buyer or other non-Organiser, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Site registration form (the "Registration Data") and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or POPTICKET Limited has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, POPTICKET Limited has the right to suspend or terminate all of your accounts and refuse any and all of your current or future use of the Services (or any portion thereof).

The site is protected by reCAPTCHA and the Google Privacy Policy and Terms of Service apply.

Payment for Organiser

Online Payment

All e-Tickets issuance will incur a POPTICKET Limited’s service charge per e-Ticket.

Online payments are processed via AlipayHK, Octopus, PayMe, Stripe and WeChat Pay. When using AlipayHK, Octopus, PayMe, Stripe and WeChat Pay, Organisers deal with the applicable monetary payment transaction through the AlipayHK, Octopus, PayMe, Stripe and WeChat Pay services, and are restricted by the applicable terms of use governing the AlipayHK, Octopus, PayMe, Stripe and WeChat Pay services.

Free e-Tickets

All e-Tickets issuance will incur a POPTICKET Limited’s service charge per e-Ticket.

All payments will be made to the local bank account designated by the organiser. Organiser will be responsible for the confirmation of payments and e-Ticket issuance.

We will transfer the balance (total e-Ticket sales minus service charges) to the organiser’s designated local bank account within 14 working days of the completion of the event.

Payment for Buyer

Online Payment

All e-Tickets issuance will incur a POPTICKET Limited’s service charge per e-Ticket.

Online payments are processed via AlipayHK, Octopus, PayMe, Stripe and WeChat Pay. When using AlipayHK, Octopus, PayMe, Stripe and WeChat Pay, Buyers deal with the applicable monetary payment transaction through the AlipayHK, Octopus, PayMe, Stripe and WeChat Pay services, and are restricted by the applicable terms of use governing the AlipayHK, Octopus, PayMe, Stripe and WeChat Pay services.

Refunds

Each organiser has his/her own refund policy, please refer to individual event page or organiser’s announcement for details.

If a full or partial refund is requested by You for any other reason, the Organiser will review the situation on a case-by-case basis. The decision on whether or not to refund any or all of the e-Ticket price will be at the Organiser’s sole discretion.

All handling fees or service fees paid for the transaction, including but not limited to customer service fees and handling or administrative fees (if applicable), will not be refunded under any circumstances.

For e-Ticket purchased online through POPTICKET Limited, You will receive a refund from POPTICKET Limited within 60 days of the event date. For e-Ticket purchased through online payment, the agreed amount will be refunded to the buyer’s credit card or digital wallet through AlipayHK, Octopus, PayMe, Stripe and WeChat Pay. A handling fee of HK$10 per refunded e-Ticket will be charged.

For e-Ticket purchased through offline payment, refund will be handled by the organiser.

The service charge for both organiser and buyer paid at the point of purchase will be non-refundable.

Event/Venue Rules and Regulations

e-Tickets are issued subject to the Rules and Regulations of the Event, issued by the Organiser and the venue. Full details are available from the Organiser on request. You and all other e-Ticket holders in Your party must comply with all relevant statutes, safety announcements and venue regulations whilst attending the Event.

General conditions across all Events

• The Organiser/Venue, not POPTICKET, is the offeror of the Services for the Events, to which the bookings correspond to, and is solely responsible for accepting or rejecting any bookings you purchase, as related to all such Services
• For any changes on purchased/registered e-Ticket, a handling fee HK$10 per e-Ticket will be charged
• E-Ticket holders must be able to produce acceptable proof of name and age
• The right of admission is reserved by the Event Organiser and venue. You may be refused entry or ejected for anti-social behaviour or other activity deemed inappropriate
• The right is reserved to alter, amend, add, withdraw or substitute Event artists, prices, date, venue, capacity, age restrictions and times
• Recording equipment of any description cannot be used without the express written approval of the Event Organiser
• Any form of resale of tickets is strictly prohibited

Termination

POPTICKET Limited, at its sole discretion, may terminate Your password, account(s) and/or Your right to use the Site at any time for any reason or no reason, including, without limitation, for lack of use, failure to timely pay any fees or other monies due, or if POPTICKET Limited believes that You have violated or acted inconsistently with the Terms and Conditions herein contained or against the letter of spirit of these Terms and Conditions.

All content available on this Website, including but not limited to all text, graphics, drawings, diagrams, photographs, logos or other materials are subject to copyrights owned by POPTICKET Limited or the Organiser. The content or any part thereof shall not be reproduced, re-published, modified, adopted, distributed, transmitted, downloaded or saved without prior written permission from POPTICKET Limited or the Organiser.

POPTICKET Limited takes your privacy seriously. This Privacy Policy explains the steps We take to ensure information about You is kept secure and confidential and complies with the requirements of the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong.

Please read this Privacy Policy carefully. Once You use this Website ("Site") or any of Our mobile phone applications ("Apps") or Our services available via it or them. You will be deemed to have read and consented to the uses of Your personal data set out in this Privacy Policy. You will also be deemed to have read and accepted this Privacy Policy and the Website terms and conditions of use ("Terms and Conditions").

You must not use Our Site or Apps or any services available via it or them if You do not accept this Privacy Policy and the Terms and Conditions.

1. Your Details And The Purposes For Which Information Is Used

1.1 You will need to register to become either Buyer or Organiser. When registering with your email or Facebook account, only the following information will be shared with us :
(a) Your name
(b) Your gender
(c) Your email address
(d) Your phone number
(e) Your Facebook ID (Facebook user only)
(f) Your profile image (Facebook user only)

1.2 This personal information and any other information You provide to Us via the Site or any Apps is required in order to process Your order, manage Your Member registration with us and to provide You with information and offers about Events and Event Organisers.

1.3 On registering with us You will be able to view Your registration details through the Your Profile page using Your email address and the password You have chosen.

1.4 You will be able to edit all the details You have given us through the Your Profile page by using Your email address and password.

If you wish to change, update or delete your personal data submitted and/or change your preference of the usage of your personal information for POPTICKET Limited and event organiser(s)’ communication purposes, please update in your profile page or send your request to ask@popticket.hk.

DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. POPTICKET LIMITED HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, NON-INFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE. POPTICKET LIMITED MAKES NO WARRANTY THAT: (I) THE SITE WILL MEET YOUR REQUIREMENTS, (II) THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE WILL BE ACCURATE OR RELIABLE, (IV) THE QUALITY, SAFETY OR LEGALITY OF ANY CONTENT, PRODUCTS, SERVICES, INFORMATION OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU, OR EVENTS ATTENDED, THROUGH THE SITE, OR THE SERVICES THEMSELVES (OR ANY PART THEREOF), WILL MEET YOUR EXPECTATIONS, OR (V) ANY ERRORS IN THE SITE WILL BE CORRECTED. POPTICKET LIMITED IS NOT RESPONSIBLE AND SHALL HAVE NO LIABILITY FOR THE CONTENT, PRODUCTS, SERVICES, ACTIONS OR INACTIONS OF ANY USER, BUYER OR OTHER NON-ORGANIZER, ORGANIZER OR THIRD PARTY BEFORE, DURING AND/OR AFTER AN EVENT; AND POPTICKET LIMITED WILL HAVE NO LIABILITY WITH RESPECT TO ANY WARRANTY DISCLAIMED IN (I) THROUGH (V) ABOVE. YOU ACKNOWLEDGE THAT POPTICKET LIMITED HAS NO CONTROL OVER AND DOES NOT GUARANTEE THE QUALITY, SAFETY OR LEGALITY OF EVENTS ADVERTISED, THE TRUTH OR ACCURACY OF ANY USERS’ (INCLUDING BUYERS’, OTHER NON-ORGANIZERS’ AND ORGANIZERS’) CONTENT OR LISTINGS, OR THE ABILITY OF ANY USER (INCLUDING BUYERS, OTHER NON-ORGANIZERS AND ORGANIZERS) TO PERFORM, OR ACTUALLY COMPLETE A TRANSACTION. THE FOREGOING DISCLAIMERS SHALL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW. Notwithstanding the foregoing, You may report the misconduct of users, Buyers, other non-Organizers, Organizers and/or third parties in connection with the Site to POPTICKET Limited. POPTICKET Limited, at its sole discretion, may investigate the claim and take necessary action.

LIMITATION OF LIABILITY

POPTICKET LIMITED SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES OR UNDER ANY LEGAL THEORY, WHETHER IN TORT, CONTRACT, OR OTHERWISE, WITH RESPECT TO THE SERVICES, OR ANY OTHER SUBJECT MATTER OF THIS TOS, FOR: (I) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF POPTICKET LIMITED HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), (II) THE COST OF PROCUREMENT OF SUBSTITUTE SERVICES, (III) AMOUNTS IN EXCESS OF HK$10.00 IN THE AGGREGATE FOR ALL CLAIMS WITH RESPECT TO THE SITE, OR (IV) ANY MATTERS BEYOND POPTICKET LIMITED’S REASONABLE CONTROL. POPTICKET LIMITED SHALL HAVE NO LIABILITY WITH RESPECT TO ANY OF YOUR CONTENT OR ANY CONTENT OF ANY OTHER USER OF THE SITE. IN ADDITION, POPTICKET LIMITED IS NOT AFFILIATED WITH, AND HAS NO AGENCY OR EMPLOYMENT RELATIONSHIP WITH, ANY THIRD PARTY SERVICE PROVIDER USED IN CONJUNCTION WITH THE SITE, AND POPTICKET LIMITED HAS NO RESPONSIBILITY FOR, AND HEREBY DISCLAIMS ALL LIABILITY ARISING FROM, THE ACTS OR OMISSIONS OF ANY SUCH THIRD PARTY SERVICE PROVIDER. THE FOREGOING LIMITATIONS SHALL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW.

1.1 Our Site uses "Session cookies" which track Your browser session. These do not store any information on Your computer but merely allow our Site to recognise Your order and its contents and whether You are logged in to Your account.

1.2 We use analytics cookies including Google Analytics and other analytics tools to gather anonymous statistical information for:
